The New Black AI

Can I use the images commercially?

Updated on November 3, 2026

Yes. Everything you create on The New Black AI, images, videos, designs and texts, belongs to you, on every plan including a free account. Our Terms of Service give you a full license to use your creations as you wish, within the limits of the law that applies to you. There is no usage fee and no extra license to buy.

What the Terms of Service say

The section « Rights of use » of our Terms of Service reads: all designs, images, videos, texts or resources created on The New Black are the property of the creator, the user, and the user has full license to use their creations as they wish within the limits of the law to which they are subject.

So you can put your images on your product pages, in your ads, on social media, in a lookbook or a printed catalogue, and send your designs and tech packs to a factory. The rule is the same on a free account and on every paid plan.

Your uploads and AI training

What you upload and what you generate is never used to train or fine tune any model, on any plan. It is processed only to give you the result you asked for.

What you are responsible for

  1. 1.Upload only photos you have the right to use. When you upload a photo to edit it, the Terms ask you to guarantee you hold the rights it needs, such as copyright and trademark rights.
  2. 2.Respect the law where you sell. A creation is yours, but its use stays within the rules of your country, for example on advertising or on the use of a real person's likeness.
  3. 3.Check each result before you publish it. The Terms exclude any warranty on the results, so look at every image as you would look at a photo from a shoot.

Good to know

If you use a photo of a real person as a model reference, make sure that person agreed to it. For a question about a specific use, write to us from Contact.
